1. WHO WE ARE
AÏBAYA is a brand operated by NovaCore LLC, a limited liability company
registered in the State of Wyoming, United States, with its registered address
at 33N Gould St, Sheridan, Wyoming 82801, United States.
In these Terms, "we", "us", "our" and "AÏBAYA" mean NovaCore LLC. "You" means
the person visiting the website or placing an order. "Website" means
aibayashop.com and any of its subdomains.

2. ACCEPTANCE OF THESE TERMS
By visiting our website, browsing our collections, or placing an order, you
agree to these Terms of Service, together with our Return and Refund Policy,
our Shipping Policy, and our Privacy Policy, which are all part of this
agreement.
If you do not agree with these Terms, please do not use the website.
3. ELIGIBILITY
You must be at least 18 years old, or the age of legal majority in your state
or province, to place an order. If you are under that age, you may only use
the website with the involvement and consent of a parent or legal guardian,
who accepts these Terms on your behalf.
By placing an order, you confirm that the payment method used belongs to you
or that you have been authorised to use it.
4. OUR PRODUCTS
We design and sell modest fashion pieces — abayas, hijabs, and related
accessories — in small, limited drops.
Our pieces carry handmade detailing. Because that work is done by hand, small
variations in embroidery, beadwork, stitching, and finish are normal and are
part of the character of the piece. They are not defects.
We make every effort to display the colours and details of our products
accurately. However, the way colours appear depends on your screen, and we
cannot guarantee that what you see on your device is an exact match for the
piece you receive.
Measurements shown in our size guide are provided as a guide and may vary
slightly from piece to piece.
Our drops are produced in limited quantities. We do not guarantee that any
product will be restocked, and we may withdraw, change, or discontinue any
product at any time.
5. PRICES AND PAYMENT
All prices are shown in US dollars and do not include shipping charges, which
are calculated at checkout, or any customs duties or import taxes, which are
described in our Shipping Policy.
We may change our prices at any time. The price that applies to your order is
the price displayed at the moment your order is confirmed.
Payment is taken in full at checkout. We accept the payment methods shown on
our checkout page. Your payment is processed by our payment providers, and we
do not store your full card details.
6. ORDERS AND ACCEPTANCE
Your order is an offer to buy. The order confirmation email we send you
acknowledges that we have received your order; it does not mean we have
accepted it. The contract between us is formed only when we send you a
shipping confirmation.
We reserve the right to refuse or cancel any order, in whole or in part, at
our discretion. This includes, without limitation, orders that appear
fraudulent, orders placed by resellers, orders exceeding reasonable
quantities, orders that cannot be shipped to the address given, and orders
affected by a pricing or stock error.
Where a product is listed at an obviously incorrect price because of a typing
or system error, we may cancel the order even after it has been confirmed. If
we do, we will notify you and refund you in full.
If we cancel an order after payment, we will refund the amount paid to your
original payment method.
7. SHIPPING, DELIVERY AND RISK
Shipping, delivery times, tracking, customs charges, and lost parcels are
covered in our Shipping Policy, which forms part of these Terms.
Risk of loss and damage passes to you when the order is delivered to the
address you provided.
8. RETURNS AND EXCHANGES
Returns, exchanges and refunds are governed by our Return and Refund Policy.
Please read it before ordering. It sets out, in particular, our rules on
hygiene, on worn or opened items, and on the cost of return shipping.
9. INTELLECTUAL PROPERTY
The website and everything on it — our name, logo, designs, product
photography, illustrations, text, and page layouts — belong to NovaCore LLC or
are used under licence, and are protected by copyright, trademark, and other
laws.
You may view and share our content for your own personal, non-commercial use.
You may not copy, reproduce, republish, sell, or use our images, designs, or
text for commercial purposes, and you may not use our name or logo in a way
that suggests a partnership or endorsement, without our prior written consent.
10. CONTENT YOU SHARE WITH US
We love seeing how our customers style their pieces, and we invite you to tag
us at @aibayashop.
If you publicly tag us, mention us, or send us photos or videos of yourself
wearing our pieces, you grant us a non-exclusive, royalty-free, worldwide
licence to re-share that content on our website, our social media accounts,
and our marketing emails, with credit to your handle. You can ask us to stop
using your content at any time by writing to contact@aibayashop.com, and we
will remove it from the channels we control.
You confirm that any content you share is yours to share, that you have the
consent of anyone appearing in it, and that it does not infringe anyone's
rights.
11. REVIEWS AND COMMENTS
If you submit a review, comment, or other feedback, you are responsible for
its content. Please do not post anything unlawful, abusive, defamatory, or
misleading, and do not include personal data belonging to someone else. We may
edit or remove content that breaches these rules.
12. ACCEPTABLE USE
You agree not to use the website for any unlawful purpose, not to attempt to
gain unauthorised access to our systems, not to interfere with the operation
or security of the website, not to use automated tools to scrape our content
or make bulk purchases, and not to transmit any virus or malicious code.
We may suspend or refuse access to anyone who breaches these rules.
13. DISCLAIMERS
The website and its content are provided on an "as is" and "as available"
basis. We do not warrant that the website will be uninterrupted, error-free,
or free of harmful components, and we do not warrant that the results obtained
from using the website will be accurate or reliable.

consequential, or punitive damages, including loss of profits, loss of data,
or loss of goodwill, arising out of your use of the website or of any product
purchased from us.
To the fullest extent permitted by law, our total liability for any claim
relating to an order is limited to the amount you actually paid for that
order.
15. INDEMNITY
You agree to indemnify and hold harmless NovaCore LLC and its officers,
employees, and suppliers from any claim or demand, including reasonable legal
fees, arising out of your breach of these Terms or your violation of any law
or of the rights of a third party.
16. PRIVACY
Your personal data is handled in accordance with our Privacy Policy, which
explains what we collect, why, and what rights you have over it.
17. CHANGES TO THESE TERMS
We may update these Terms from time to time. The version in force is the one
published on this page, with its "last updated" date. Changes take effect when
they are published. Your continued use of the website after that date means
you accept the updated Terms.
The Terms that apply to an order are the ones in force on the day the order
was placed.
18. SEVERABILITY
If any provision of these Terms is found to be unlawful or unenforceable, that
provision will be severed and the remaining provisions will continue in full
force.
19. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of the State of Wyoming, United States,
without regard to its conflict of law rules. Any dispute arising from these
Terms or from an order will be brought before the competent courts of the
State of Wyoming, unless mandatory consumer protection law in your place of
residence gives you the right to bring proceedings elsewhere.
